To all Residential Rental Unit Owners and Rental Property Managers,
 
The Township of Hamilton has adopted Ordinance #1708-2011 on December 5th, 2011 which states that the Bureau of Fire Prevention Office is to require Residential Rental Unit Licenses, Tenant Occupancy Permits and Periodic Habitability Inspections and Re-Inspections for all Rental Units within the Township of Hamilton.
 
Residential Rental Unit License Applications must be completed and submitted to the Bureau of Fire Prevention Office by the owner of the rental property by March 31, 2012. The annual fee for this license is $100.00. Failure to do so within 90 days from the adoption of this ordinance and each and every day thereafter shall be deemed a separate violation, the penalties for violations of this article include a fine not exceeding $1,000.00 or imprisonment for a term not exceeding 90 days.
 
Tenant Occupancy Permits Applications must be completed by the tenant occupying the rental unit and submitted to the Bureau of Fire Prevention Office by the owner of the rental unit once the Residential Rental Unit License has been issued. The fee for this permit is $25.00. Failure to do so within 90 days from the adoption of this ordinance and each and every day thereafter shall be deemed a separate violation, the penalties for violations of this article include a fine not exceeding $1,000.00 or imprisonment for a term not exceeding 90 days. 
 
Habitability Inspections & Re-Inspection Applicationsupon change of occupancy the Habitability Inspection Application must be completed and submitted to the Bureau of Fire Prevention Office by the designated representative once the Residential Rental Unit License and the Tenant Occupancy Permit have been issued on the rental unit. Please note that for the next five (5) years the inspections will only be conducted prior to occupancy of the unit by a new tenant. Beginning in 2017, all units will be inspected annually.  The designated representative must be present at the time the Habitability Inspection takes place and must be 18 years of age or older. The fee for this inspection is $125.00 (which includes a fire inspection fee of $50.00). Should the rental unit fail the initial inspection; all re-inspections conducted thereafter on the unit will be subject to a fee of $50.00. Failure to do so within 90 days from the adoption of this ordinance and each and every day thereafter shall be deemed a separate violation, the penalties for such violations of this article include a fine not exceeding $1,000.00 or imprisonment for a term not exceeding 90 days.
