To all Residential Rental Unit Owners and Rental Property Managers,
The Township of Hamilton adopted Ordinance #1727-2012 a revision to Ordinance #1708-2011, which states that the Bureau of Fire Prevention Office is to require Residential Rental Unit Licenses and Periodic Habitability Inspections and Re-Inspections for all Rental Units within the Township of Hamilton. The term of all Residential Rental licenses issued shall commence January 1 of each year, and such licenses shall be valid until December 31 of said year, at which time it shall expire and a Renewal License shall be required.
Residential Rental Unit License Applications and Renewals must be completed and submitted to the Bureau of Fire Prevention Office by the owner of the rental property by January 31, 2013. The annual fee for this license for the license year of 2015 is $70.00. A late fee of $50.00 will be charged in addition to the above fee for all Residential Rental Unit Licenses obtained after the required due date. Failure to do so within 90 days from the adoption of this ordinance and each and every day thereafter shall be deemed a separate violation, the penalties for violations of this article include a fine not exceeding $1,000.00 or imprisonment for a term not exceeding 90 days.
Habitability Inspections & Re-Inspection Applications upon change of occupancy the Habitability Inspection Application must be completed and submitted to the Bureau of Fire Prevention Office by the designated representative once the Residential Rental Unit License and the Tenant Occupancy Permit have been issued on the rental unit. Please note that for the next five (5) years the inspections will only be conducted prior to occupancy of the unit by a new tenant. Beginning in 2017, all units will be inspected annually. The designated representative must be present at the time the Habitability Inspection takes place and must be 18 years of age or older. The fee for this inspection is $125.00 (which includes a fire inspection fee of $50.00). Should the rental unit fail the initial inspection; the owner shall be entitled to one Re-Inspection without charge each year. All subsequent re-inspections conducted thereafter on the unit will be subject to a fee of $50.00.
